These Terms and Conditions apply to legal relationships established with VILA VITA Marburg SE, headquartered in Marburg (hereinafter referred to as “VILA VITA”), through this online shop, in particular regarding:

- the purchase of admission tickets for events (“Tickets”);

- the purchase of vouchers for services (“Vouchers”) offered by VILA VITA Marburg SE, headquartered in Marburg;

- the purchase of food products, takeaway orders or other goods (“Goods”).

2. Only persons who are at least 18 years old and legally competent are entitled to make purchases.

1. The presentation of goods in the online shop does not constitute a binding offer to conclude a purchase contract. Rather, it is a non-binding invitation to purchase.

2. By clicking the button [“Place order with obligation to pay”], you submit a binding purchase offer.

3. The contract between the customer and VILA VITA is concluded only upon receipt of payment of the purchase price. Subsequently, VILA VITA provides the ticket/voucher for download and printing or confirms receipt of the goods order.

4. Tickets/vouchers not printed by the customer themselves will be sent by post to the shipping address provided by the customer. The customer bears the shipping costs incurred. In this case, VILA VITA is not liable for delays in postal delivery.

5. If ordered tickets/vouchers are delivered but not paid for by the customer, there shall be no entitlement to the services specified in the ticket/voucher.

1. All prices are stated exclusively in EURO. Unless expressly agreed otherwise, the prices in VILA VITA’s offers include statutory VAT and, where applicable, sparkling wine tax.

2. Risk passes to the customer as soon as the shipment has been handed over to the person carrying out the transport or has left VILA VITA’s warehouse for shipment. If the customer is a consumer, risk passes only upon delivery to the customer.

3. The delivered goods, including packaging, remain the property of VILA VITA until full payment has been made.

4. VILA VITA reserves the right to replace individual products with goods of equivalent type and quality if the originally intended goods are unavailable. In the case of wines, fruit and vegetables or products made from fruit or vegetables, changes in vintage or origin are possible.

6. VILA VITA charges a flat fee of EUR 12.40 per ordered gift basket for packaging and shipping within Germany, unless otherwise stated in individual cases.

7. Pickup times and pickup locations for our takeaway orders can be found on our website. Please note that takeaway orders can only be collected upon presentation of the order confirmation or by stating the name of the person who placed the order. Any loss of quality due to delayed pickup is at the expense of the customer and will not be refunded or accepted for return. The same applies to orders that are not collected.

1. Payment is generally made by credit card, PayPal or Klarna online transfer. The selection of available payment methods is at the discretion of VILA VITA. VILA VITA reserves the right to offer only selected payment methods.

2. The invoice amount is due immediately unless VILA VITA specifies a different payment deadline.

3. In the event of default in payment, VILA VITA is entitled to demand the statutory default interest applicable at the time. VILA VITA reserves the right to prove and claim higher damages.

4. The customer may only offset or reduce claims against claims of VILA VITA if such claims are undisputed or legally established.

5. When paying by credit card, the purchase price is charged to the customer’s credit card account at the time of the order.

6. When paying via PayPal or Klarna, the customer will be redirected to the website of the respective online provider during the ordering process and may need to be registered there in order to complete payment. Further information regarding payment processing, terms and conditions, and data protection notices of the respective online provider can be found on their websites (www.paypal.com or www.klarna.com).

1. Deliveries are only possible within Germany. Fresh and refrigerated deliveries are excluded for German islands.

2. If not all ordered products are in stock, VILA VITA is entitled to make partial deliveries if this is reasonable for the customer. Any deadlines shall only commence upon receipt of the final partial delivery.

3. If the delivery of perishable goods is the subject of this contract, the following applies: The customer shall ensure acceptance of perishable goods at the agreed delivery time through suitable arrangements, e.g. by personally accepting the goods, authorizing another person to accept delivery at the specified address, or informing VILA VITA of the name and address of a neighbor willing and authorized to accept delivery.

4. Delivery of ordered goods is subject to availability. If goods are unavailable at the time of ordering, the customer will be notified of the expected delivery date and the order will be reserved by VILA VITA. As soon as the goods are back in stock, they will be shipped without further notice. In the event of non-availability, especially if a limited stock item (e.g. vintage wine) is sold out, the customer will be informed. Payments already made will be refunded immediately.

5. Delivery of spirits or other items subject to statutory sales restrictions will only be made to recipients who meet the legal requirements and upon presentation of an identity card.

6. In exceptional cases, VILA VITA is not obliged to deliver ordered goods if VILA VITA has properly ordered the goods but has not been supplied correctly or on time by its own supplier.

1. Tickets for VILA VITA events may generally only be purchased directly from VILA VITA or from third parties authorized by VILA VITA (“authorized sales outlets”). Additional terms may apply for ticket purchases from authorized sales outlets.

2. By concluding a contract with VILA VITA or an authorized sales outlet for the purchase of tickets, the customer acquires the right to attend the respective event in accordance with these Terms and Conditions.

3. Even if ticket sales are conducted via distance communication means within the meaning of Section 312b para. 2 German Civil Code (BGB), no distance selling contract exists pursuant to Section 312b para. 3 no. 6 BGB. Therefore, there is no right of withdrawal or return.

1. The purchase, use and transfer of tickets are permitted exclusively for private purposes unless VILA VITA expressly agrees otherwise. Commercial resale of tickets is prohibited. In the event of violations, VILA VITA is entitled to block the affected tickets and deny the holder access to the event without compensation.

2. Exchange and return of tickets are excluded. If a customer cannot use their ticket for personal reasons (e.g. illness), transfer to a third party is exceptionally permitted.

3. In the event of a change in time or location of the event, tickets remain valid. Unless VILA VITA is at fault, there is no entitlement to a refund of the purchase price. The same applies in the event of interruption or cancellation of an event.

1. Access to the event is granted only upon presentation of a valid ticket. Access may be denied if the customer refuses to undergo a security check of their person and/or carried items by VILA VITA or security personnel before entering the venue. In the event of denied access, the customer/ticket holder shall not be entitled to compensation.

2. VILA VITA and/or persons commissioned by VILA VITA exercise domiciliary rights. Instructions issued by them must be followed. In the event of violations, breaches of house rules, these Terms and Conditions, or for any other important reason, access to the venue may be denied or the ticket holder may be removed from the venue. No replacement claims shall exist in such cases.

3. It is prohibited to bring or carry weapons, dangerous objects, drugs, alcoholic beverages or pets into the venue area.

4. It is also prohibited to bring, use and/or distribute political or religious propaganda material or commercial advertising material within the venue area without prior consent from VILA VITA.

5. If food and beverages are available during an event, they are provided exclusively for on-site consumption for hygiene reasons unless expressly agreed otherwise.

6. Presence within the venue area for media reporting purposes and reporting itself are only permitted with prior consent from the organizer.

7. The creation of image and/or audio recordings is prohibited. Bringing recording devices into the venue is prohibited.
